December 2014 - Efforts to overturn the plastic bag ban signed earlier this year by Gov. Jerry Brown are closing in on the final weeks of signature collection to qualify a referendum for the 2016 ballot.

The law, SB 270 (Padilla), prohibits the distribution of plastic bags in grocery stores and pharmacies starting July 2015 and from convenience and liquor stores starting July 2016. Under this bill, retailers will have to charge 10 cents or more for recycled paper bags.
 
Existing city bans were grandfathered into the law enabling local governments with bag bans to continue enforcing their local restrictions. The League did not have a position on SB 270, however it worked to ensure that local ordinances would remain as well as cities’ authority to regulate single use bags in retail establishments not covered by the bill.
 
Proponents of the referendum need to gather 504, 760 valid signatures by the circulation deadline of Dec. 29, 2014. Should the referendum qualify, it would prevent the implementation of SB 270 until voters decide its fate in 2016.
