November 4, 2023 - Los Angeles County District Attorney George Gascón announced on Friday that Miguel Avila has been charged with felony george gasconassault with the intent to commit a forcible sex crime as well as sexual battery.

Last month, the Long Beach Police Department submitted a case against the defendant. However, at that time, the evidence presented did not substantiate a felony filing. Consequently, the matter was referred to the Long Beach City Prosecutor’s Office for misdemeanor filing consideration. After filing a misdemeanor, the Long Beach City Prosecutor reached out to our office with new evidence that was not initially submitted to us.

An experienced prosecutor in our Sex Crimes Division meticulously reviewed the new evidence and made the decision to file a felony charge.  

“The pursuit of justice requires careful scrutiny and a commitment to upholding the safety of our community. In light of new evidence, we have taken decisive action to ensure that those who commit serious sex crimes are held accountable,” District Attorney Gascón said. “I commend the victim for her bravery in coming forward. I want to emphasize that we will pursue this case with unwavering commitment. The accused will be held accountable for his actions.”

Miguel Avila (dob 11/18/92) is charged in case NA122742 with one felony count of assault with intent to commit a forcible sex crime, and one count of misdemeanor sexual battery.

On October 20, Avila allegedly saw the victim walking down a street in Long Beach when he exposed himself and followed her. As he approached her from behind, he allegedly pulled up her skirt and sexually assaulted her. A bystander intervened, at which point the defendant fled.

The prosecution will request that bail be set at $150,000.
