October 25, 2020 - Washington, D.C. – On Thursday, Speaker Nancy Pelosi issued this statement after the U.S. District Court for the Northern District of California ruled in the case of City of San Jose v. Trump that President Trump’s order to exclude undocumented immigrants from the population count that will be used to apportion seats in Congress after the 2020 Census is unconstitutional:

“Today’s ruling is a monumental victory for justice, our Constitution and our American Democracy.  The Court has rightfully ruled that an ‘actual enumeration’ of the ‘whole number of persons’ in our country is a Constitutional matter – not only a statutory one.

“The Census is a pillar of our democracy, enshrined by our Founders to ensure that all people who live in the America, regardless of citizenship, are equally counted and represented.  Specifically, the Constitution provides that ‘Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State.’  Today, the Court has agreed with the House’s amicus brief that the President’s unlawful memorandum is a blatant violation of the Constitution and the rule of law, and cannot be allowed to stand.

“The Trump Administration’s shameful, years-long anti-immigrant attacks are designed to inject fear and uncertainty into vulnerable communities, and to cause traditionally undercounted communities to be even further underrepresented and left behind.  The House of Representatives will continue to fight in the Courts and in Congress to ensure a fair and accurate Census as the Constitution and our oath demand.  House Democrats are committed to defending our patriotic immigrant communities as we work to ensure that every person in every community is counted.”
