October 1, 2021 - On Thursday, September 30, 2021, a Merced County Jury returned guilty verdicts on all counts alleged against Marcos Millan of Livingston. The jury heard testimony this week describing Mr. Millan’s continued abuse of the confidential victim that started when the child was five or six years old. The confidential victim related incidents of substantial sexual conduct that occurred in Atwater and continued when the family moved to Merced. During the summer of 2018, when the confidential victim was ten years old, the child disclosed the abuse to a family member who immediately informed the child’s mother. The details were then reported to the Merced Police Department.
Yesterday, Mr. Millan was found guilty of violating one count of Penal Code, Section 288.7(a), Sexual Intercourse or Sodomy of a Child Ten Years or Younger; three counts of Penal Code, Section 288.7(b), Oral Copulation or Sexual Penetration of a Child Ten Years or Younger; and two counts of Penal Code, Section 288(a), Lewd Acts upon a Child under Fourteen. Judge Carol Ash presided over the trial.
Mr. Millan will return to her courtroom on October 29, 2021 for sentencing. He faces a maximum sentence of seventy years to life, plus an additional ten years in state prison. Deputy District Attorney Sara Rosenthal prosecuted the case. Detective Cruz Jasso from the Merced Police Department led the investigation with assistance from the Merced County Human Services Agency Child Welfare Services Division.
