Domestic Abuser Sentenced to Life in Prison
September 7, 2024 – Nevada County District Attorney's Office officials report that District Attorney Jesse Wilson announces the sentence in the case of People v. Kevin Foster.
Foster was convicted by a Nevada County jury on December 7, 2023, on multiple counts of felony domestic violence, to include two serious strike offenses (245(a)(1), 422, 236, 273.5, 236.
The convictions arose from conduct on August 14, 2023, in which Foster threatened and assaulted his long-term girlfriend, holding a knife to her throat and restricting her from leaving his home as she begged him to allow her to leave. In 2012, Foster suffered two prior strike offenses for domestic violence and witness dissuasion against a former girlfriend. Prior to 2012, Foster suffered multiple convictions for domestic violence against his ex-wife.
Following the conviction at jury trial, the defendant exercised his right to appeal and filed a motion for new trial with the Court. Both sides filed their respective motions and after hearing argument on the issues, the Court ultimately sided with the prosecution and denied the defendant’s motion.
On August 30, 2024, Foster was sentenced to an aggregate terms of 33 years 8 months to Life in prison. Specifically, Foster was sentenced to an indeterminant term of 25-life on his third strike offense, consecutive to a determinant term of 8 years 8 months.
The case was prosecuted by DDA Lydia Stuart and the Investigating Officer was Nevada County Sheriff Deputy Taylor King.
The victim displayed significant courage and perseverance throughout the trial process, with the support of Victim Advocate Kim Leland. The victim is grateful for the efforts of Nevada County Sheriff's Office and the Office of the District Attorney and is grateful for the outcomes of the criminal justice process. She is furthermore relieved that Foster will no longer pose a threat to women in the community.
