RECOMMENDATION:

1) Waive further reading of the ordinance; 2) Open Public Hearing and receive public comments; 3) Close the Public Hearing; 4) Adopt Ordinance reducing the Planada Recreation Committee members from 7 to 5.

COMMUNITY AND ECONOMIC DEVELOPMENT - PUBLIC HEARING - PROPOSED ORDINANCE

To consider approving Zone Code Text Amendment No ZCTA-001 and adoption of the proposed ordinance amending Merced County Code Chapter 18.26 (Industrial Zones), Section 18.26.020 (Allowable Land Uses and Permit Requirements), Table 18-10 (Manufacturing Zones/Land Use Permits Guide), to allow emergency shelters in industrial zones; and Chapter 18.56, Section 18.56.010 (Definitions and Construction of Words and Phrases) to revise the emergency shelter definition and to add transitional housing and supportive housing definitions under community care facility.

RECOMMENDATION:

1) Waive further reading of the ordinance; 2) Open the Public Hearing and receive public comments; 3) Close the Public Hearing; 4) Find the Zone Code Text Amendment is exempt from CEQA Guidelines under Section 15061 (b)(3); 5) Adopt Ordinance amending Chapter 18.26, Section 18.26.020, Table 18-10; and Chapter 18.56 of the Merced County Code.

HOUSING ELEMENT UPDATE STUDY SESSION:

RECOMMENDATION:

1)Receive presentation from Mintier Harnish on the Housing Element Update; 2) Confer among Board members and provide direction to the consultant and County Staff on the desired goals, policies, and programs of the draft Housing Element Update; 3) Allow the public opportunity to speak concerning the draft goals, policies, and programs; and 4) Direct the consultants and staff to make any specified changes to the proposed Housing Element Update draft and submit to California Department of Housing and Community Development for their review.

Public Works

1.        Approve and authorize the Director of Public Works to execute Amendment to Project Supplement 15 to Contract No. 2007256 with Environmental Science Associates for the Burchell Avenue at Duck Slough Bridge Replacement Project.

2.        Approve Budget Transfer in the amount of $4,350,000 to add appropriation to the Atwater-Merced Expressway fixed asset to cover the remainder of the construction contract. (4/5 Vote Required)

Ag. Commissioner

3.        Approve and authorize the Chairman to sign Renewal Contract No. 2010115 with California Department of Food and Agriculture to provide for Asian Citrus Psyllid pest detection trapping and survey activities.

Health

4.        Approve and authorize the Chairman to sign Amendment Contract No. 2007078 with Air Methods Corporation to provide exclusive air ambulance services.

Mental Health

5.        Approve and authorize the Chairman to sign Amendment Contract No. 2015218 with Casa Del Sol, Inc. for client board and care services.

6.        Approve and authorize the Chairman to sign Amendment Contract No. 2013226 with Jackson & Coker LocumTenens, LLC for the placement of licensed psychiatrists on a limited basis and will include the use of Telehealth services for the 2015-2016 portion of the contract; and return to the Board for further action once the vacant Staff Psychiatrist positions are filled.

7.        Approve and authorize the Chairman to sign Amendment Contract No. 2015046 with Calaveras County for inpatient services at the Marie Green Psychiatric Health Facility.

8.        Approve and authorize the Chairman to sign Amendment Contract No. 2014201 (State Agreement No. 14-90071) with Department of Health Care Services for Substance Use Disorder (SUD) Services; and adopt resolution to approve and authorize execution of the Standard Agreement.

Human Services Agency

9.        Approve and authorize the Chairman to sign Amendment Contract No. 2014194 with Merced County Office of Education for the services of a Child Development Specialist.

10.     Approve and authorize the Chairman to sign Interdepartmental Amendment Contract No. 2007091 with Merced County Counsel for departmental legal services.

11.     Approve and authorize the Chairman to sign Renewal Contract No. 2015052 (State Revenue Contract #MI-1517-31) with California Department of Aging for a Medicare Improvement for Patient and Provider Act Program; adopt resolution and approve related budget transfer. (4/5 Vote Required)

Sheriff

12.     Approve Budget Transfer in the amount of $75,000 to purchase one additional Animal Services Truck. (4/5 Vote Required)

Community and Economic Development

13.     Set a Public Hearing for March 22, 2016 at 10:00 a.m., to recommend amendment of the agricultural preserve with reference to six parcels, resulting from three Property Line Adjustments and one Minor Subdivision (Convey and Combine), located at: 1) the North side of W. Oak Avenue, one half mile West of N. Buhach Road in the Merced area; 2) the South side of W. El Capitan Way, 0.65 miles West of N. Cortez Avenue in the Delhi area; 3) the Southeast corner of Eucalyptus Road and Aubrey Avenue in the Dos Palos area; and 4) the West side of S. Highway 33, 0.3 miles North of W. Husman Road in the Gustine area, as per the requirements of the Land Conservation Act of 1965 (Williamson Act) Section 51200 et seq. of the California Government Code.

PUBLIC WORKS

23.     Contract with McDonough, et al. for acquisition of an access easement needed to finalize the Van Clief Road over East Side Canal Bridge Replacement Project; 2) Authorize the Chairman to sign the agreement for purchase of real property listing the terms and conditions of the acquisition; 3) Adopt Resolution accepting the easement deed; and 4) Approve payment to Fidelity National Title Company for the agreed value of the property plus escrow and any other transaction fees.

24.     Accept the Final Map for Villa Cordoba Unit No. 2, Phase 1, Major Subdivision No. 07002, located in the Hilmar Community Plan area.

25.     Adopt resolution accepting the engineer's report and forming Major Subdivision No. 07002 into the Villa Cordoba Unit 2 Park Maintenance Zone of Benefit #128 in County Service Area No. 1.

26.     Approve the increase in the project budget for the Human Services Agency Tenant Improvements at Castle Commerce Center; 2) Authorize the Board to award the construction contract to Harris Builders; 3) Authorize the Chairman to execute said construction contract upon review of County Counsel; and 4) Approve related budget transfers.

HEALTH

27.     Contract with Zoll Data Systems, Inc. for the Computer Aided Dispatch System digital geographic mapping upgrade; and approve related Budget Transfer.

MENTAL HEALTH

28.     Approve the Permanent Supportive Housing renewal applications for Project Home Start and Project Hope Westside, as part of the County's portion of the 2015 Merced County Continuum of Care Plan; 2) Upon approval of either housing application by the U.S. Department of Housing and Urban Development, authorize the Department to return to the Board for approval of grant agreements.

29.     Contract with Regents of the University of California for clinical learning experience for medical student interns from UC Davis.

30.     Authorize Mental Health to apply for California Health Facilities Financing Authority, Investment in Mental Health Wellness Grant funds, for Peer Respite Care Programs; return to the Board for any subsequent approval related actions necessary for implementation of the grant project.

31.     Authorize Mental Health to apply for California Health Facilities Financing Authority, Investment in Mental Health Wellness 5th Round Grant funds, for Crisis Stabilization programs; return to the Board for any subsequent approval related actions necessary for implementation of the grant project.

HUMAN SERVICES AGENCY

32.     Authorize the Dept. of Administrative Services, in conjunction with Human Services Agency, to initiate the procurement process for counseling services; return to the Board with the negotiated agreement between the department and provider, upon review by County Counsel for final contract approval and signature.

COMMUNITY AND ECONOMIC DEVELOPMENT

33.     Authorize the Dept. of Administrative Services, in coordination with the Community and Economic Development Dept. to prepare and release a Request for Proposal for services of a qualified contractor to provide Grant Writing, Administration and Implementation of Housing Programs and return to the board for contract approval.

34.     Contract with Godinho Dairy LP for the consultant, Environmental Planning Partners, Inc., to prepare an Environmental Impact Report for the Godinho Dairy Expansion project (CUP15-018).

35.     Contract with Environmental Planning Partners, Inc. to prepare tasks for an Environmental Impact Report for the Godinho Dairy Expansion project (CUP15-018).

ELECTIONS

36.     Adopt resolution to call for an election on June 21, 2016 to fill the Merced County Employees' Retirement Association Board seat set to expire June 30, 2016 for the #3 General Member for the new term commencing July 1, 2016.

SPRING FAIR

37.     1) Request that the Board approve a cash flow loan to Spring Fair from the General Fund of up to $1,000,000 bearing an interest rate equal to the rate earned by the Merced County Treasury, with loan repayments made as payments are received from the buyers, prior to October 31, 2016; 2) Authorize the Auditor-Controller to utilize $8,000 of the loan proceeds to increase Spring Fair's change fund for operation of the 2016 Fair. Spring Fair will return the $8,000 at the close of the fair; 3) Approve related budget transfer. (4/5 Vote Required)

TREASURER/TAX COLLECTOR

38.     Acceptance of the Quarterly Investment Report for the period of October 1, 2015 to December 31, 2015.

EXECUTIVE OFFICE

39.     Recognize April 10-16, 2016 as National Volunteer Week; direct staff to coordinate applications, nominations and the screening committee; set March 29, 2016 as the deadline to receive applications/nominations; set April 26, 2016 as the date for awarding the Volunteer Recognition and Service Program certificates.

40.     Approve the 2016 Legislative Agenda with any revisions as recommended by the Board of Supervisors; authorize the Board Chair and County Executive Office to periodically provide letters of support or opposition as needed based on any benefit or detriment to the County of Merced; and direct staff to forward the 2016 Legislative Agenda to Merced County's legislative representatives and advocates.

41.     Authorize $500 of District One's Special Board Project Funds to be forwarded to the Livingston Knights of Columbus to support their Annual Kite Festival.

42.     Authorize $500 of District One's Special Board Project Funds to be forwarded to the Le Grand High School for the Denise Flores-Buiton Scholarship Fund.

43.     Authorize $800 of District One's Special Board Project Funds to be forwarded to the Planada Community Services District for the purchase of a lawnmower.
