Statement on Grand Jury Jail Report 

July 13, 2023 - San Diego County Sheriff’s Department officials report that on May 10, the 2022/2023 Grand Jury released a report entitled, "Crisis in Treatment Access for Incompetent to Stand Trial Incarcerated Persons in the County Jails." This report highlighted the Grand Jury's findings and recommendations related to the Incompetent to Stand Trial (IST) population currently housed at san diego county sheriff department logoSan Diego County jails, awaiting transfer to California state hospitals for the purpose of competency restoration.  

Per California Penal Code 1370, the State of California is responsible for the competency restoration of any individual who is deemed mentally incompetent to assist in their own defense during criminal proceedings. Once deemed by the California Department of State Hospitals (DSH) as restored, an individual can return to county jails to resume court proceedings. The State of California has a wait list statewide for acceptance into DSH facilities to begin the competency restoration process.   

In 2017, in order to help alleviate this waitlist, the San Diego County Sheriff's Department partnered with DSH to provide Jail Based Competency Treatment (JBCT) programs in county jail facilities. The Grand Jury's report acknowledged the efforts by the Sheriff's Department to provide additional resources to the IST population and provided a list of recommendations for additional services.

The Sheriff's Department completed a response to all the findings and recommendations presented by the 2022/2023 Grand Jury. We have already implemented some of the findings and we have explained our processes and restrictions regarding areas where we could not or do not agree with some conclusions.  

The San Diego County Sheriff's Department is very appreciative of the Grand Jury's thorough review, assessment and recommendations of our current policies and programs related to our IST population.
