July 5, 2025 – Modoc County Sheriff’s Office officials report that on Monday, June 30, 2025, charges have been filed against Modoc County Sheriff logothree individuals in connection with an ongoing homicide investigation into the death of 41-year-old Emmanuel Pochylski of Davis Creek, California.

The case was brought to light when concerned citizens contacted the Modoc County Sheriff’s Office to report suspicious activity at a residence in Davis Creek and raised concerns that Pochylski had not been seen for several days. Deputies immediately initiated a missing person investigation. Information gathered indicated that Pochylski was last seen on June 11, 2025. A search warrant was subsequently executed at a residence on Highway 395, where deputies located evidence suggesting that Pochylski was deceased. That evidence, along with the discovery of human remains in a shallow grave near the Plum Valley Campground on June 27, ultimately confirmed Pochylski's death.

As a result of the investigation, Christina C. Love (39), Benjamin J. Kiser (27), and Durrell J. Chambers (37) have been taken into custody. The District Attorney's Office has formally filed the following charges: 

Christina Love has been charged with willful, deliberate, and premeditated murder with special allegations of murder for financial gain, murder with exceptional depravity, and felony murder during the commission of mayhem; two counts of conspiracy to commit a crime; accessory after the fact; inflicting injury on a cohabitant or intimate partner; and multiple special allegations including great bodily injury in the context of domestic violence, committing an offense while out on bail or own recognizance, targeting a vulnerable victim, inducing others to participate in the crime, planning and sophistication in the commission of the offense, abuse of a position of trust, violent conduct, increasing seriousness of prior convictions, and committing the offense while on probation or parole. Benjamin Kiser and Durrell Chambers have been charged with willful, deliberate, and premeditated murder with special allegations of murder for financial gain, murder with exceptional depravity, and felony murder during the commission of mayhem; two counts of conspiracy to commit a crime, and accessory after the fact. Chambers has also been charged with violating conditional release orders in other pending cases.

All three defendants are scheduled to be arraigned on Monday, July 14 at the Modoc County Superior Court. Chambers and Kiser are currently being held on $1,065,000 bail, while Love is being held on $1,040,000 bail.

Our office is currently assessing whether or not the Death Penalty will be sought in this case. Our office is actively prosecuting this case and remains in close coordination with the Modoc County Sheriff’s Office as the investigation continues. We extend our sincere appreciation to the Sheriff’s Office and the many allied agencies whose tireless efforts have been instrumental in advancing this case. These include the California Highway Patrol (Alturas Area), CAL FIRE Lassen-Modoc Unit, the California Department of Justice Bureau of Forensic Services, Lake County Oregon Sheriff’s Office, and the Modoc County Sheriff’s Posse. Their professionalism and inter-agency collaboration have been vital to the pursuit of justice in this matter. This investigation remains active, and additional charges may be filed as new evidence emerges. As this is an ongoing criminal matter, the District Attorney's Office will refrain from further public comments to preserve the integrity of the case and the right to a fair trial.
