February 23, 2024 – WASHINGTON — A Philadelphia man has been arrested on felony and misdemeanor charges related to his conduct during the breach of the U.S. Capitol on Jan. 6, 2021. His actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the 2020 presidential election.
Kenneth Giusini, 67, of Philadelphia, Pennsylvania, is charged in a criminal complaint filed in the District of Columbia with a felony offense of obstruction of law enforcement during civil disorder and misdemeanor offenses of entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, disorderly conduct in the Capitol grounds or buildings, and parading, demonstrating or picketing in the Capitol grounds or buildings.
The FBI arrested Giusini on Thursday in Philadelphia. He will make his initial appearance in the Eastern District of Pennsylvania.
According to allegations in court documents, law enforcement authorities reviewed surveillance footage from the U.S. Capitol building that showed Giusini entered the Capitol via the north door at approximately 3:10 p.m. on Jan. 6, 2021. Inside the building, a line of officers were in the hallway blocking rioters, including Giusini, from further entering the Capitol. Giusini stood in the hallway apparently filming officers for over one minute before officers were able to push the rioters, including Giusini, back out of the north door.
Outside the building, body-worn camera footage shows officers clearing rioters out of the North Door at approximately 3:12 p.m. -is seen present in the area of the North Portico. As officers attempt to clear the rioters, Giusini is seen approaching the doorway and shoving an officer. Another police officer then removes Giusini from the area. However, Giusini returned and continued to use his shoulder to push against police before being removed again.
The U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section are prosecuting this case. The U.S. Attorney's Office for the Eastern District of Pennsylvania provided valuable assistance.
The FBI's Philadelphia and Washington Field Offices are investigating this case. The U.S. Capitol Police and the Metropolitan Police Department provided valuable assistance.
In the 37 months since Jan. 6, 2021, more than 1,313 individuals have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including more than 469 individuals charged with assaulting or impeding law enforcement, a felony. The investigation remains ongoing.
